About Us

The Licensing Policy governs the usage authorization for products purchased from our site or through our listed products in OpenCart.com. The below guidelines are generally applicable to all extensions, templates and associated software that are developed by us and purchased by our customers, with  individual usage specifications varying as per the licensing options that has been purchased.


License Agreement between us (Xtensions) and the Purchaser

The below guidelines, restrictions of usage, voiding factors and consequences of misuse together constitute the License Agreement between the “Purchaser” and us (“Xtensions”). The License Agreement is effective in its below entirety, with only the Licensing options varying as per the purchase option selected.

Upon a successful purchase of our products, the customer gets a complete lifetime usage right on the product corresponding to the usage as determined by the type (Single Domain, Up to Five Domains, Unlimited Domains usage) opted for.

Each such product purchase includes one year of free premium support and updates, which can be renewed by choice upon completion of that term. Unless renewed, the customer would not be getting any support or future updates, but would be free to continue using the product as per the specific licensing option.


Purchase

The “Purchase” of the product is through the fulfillment of the specific payment conditions for that product, with the File being distributed to the customer through our website user account, E-Mail or our support ticketing system. Upon a successful purchase and receipt of the product, the customer acknowledges by default that all the below guidelines, restrictions of usage and elaborations of licensing options have been read, understood and affirmed to be followed.

The “Purchase” can be made by a single entity-either an individual or a firm, and the purchaser can be a distinct entity or acting on behalf of its “Client”. All the below guidelines and restrictions apply to either of the purchasing entities.


Registration

The “Purchase” requires the product to be registered on our website, and not doing so would void the License Agreement. The customer is also required to specify the usage domains in which the product would be used


License Types

The various licensing options relate to the number of domains in which the product can be used, with the default licensing option being for “Single Domain”. The customer is required to adhere to the domain usage restrictions as elaborated below.

 Within a single domain with an active Open Cart installation, the below definitions govern the usage type:

  1. The domain restriction does not limit the product usage within sub domains or constituent directories within that domain. It implies that that the usage can be multiple Open Cart installations within the same domain.
  2. Such multiple installations can be any number of sub-domains within the same domain, or the different directories within the same domain
  3. However, the customer cannot use the product in different domains if the licensing option selected is Single Domain.


Restrictions on Usage

Each product that is sold from our website or through our listed account in OpenCart.com carries the below guidelines of usage that need to be irrevocable adhered to. Any lapse in following the usage guidelines would void the licensing agreement and its obligations on us, and would make the customer liable to legal action in cases of copyright, proprietary and intellectual data violations.

Customers are irrevocably required:

  1. Not to resell or freely distribute the product- either in part or whole.
  2. Not to sub-license the product to a different user- either in part or whole.
  3. Not to include the product-either in part or whole into a different product.
  4. Not to exchange the product-either in part or whole
  5. Not to use the product in a different domain except from what has been specified in the registration process.
  6. Not claim to have developed the product or change its name and identifying information in any channel of usage and representation.
  7. Not to extract the product (Source Code) into individual components or modules, or attempt to reverse engineer the product, or use its extracted components in any manner.

The Licensing Agreement would be applicable in case of the usage meeting the intended specification without any deviations as listed above, and requires the customer to agree to the guidelines.


License Types

The License types can be either of the below and need to be chosen at the time of purchase. No refund of the purchase amount would be binding on us in case of termination of the License Agreement. All general and specific guidelines along with restrictions of usage as mentioned above need to be irrevocably adhered to for enforcing the License Agreement and any deviation would lead to an automatic termination of this agreement.


Single Domain

The default Single Domain license allows the customer to use the product in a single domain, with all the above guidelines and restrictions being followed. The customer would follow the “Purchase” AND “Registration” process to validate the purchase and make this agreement effective.


Up to 5 Domains

This License type allows the product to be used in 5 different domains, with all the above guidelines and restrictions being followed. The customer would follow the “Purchase” AND “Registration” process to validate the purchase and make this agreement effective.


Unlimited Domains

This License type allows the product to be used in unlimited number of domains, with all the above guidelines and restrictions being followed. The customer would follow the “Purchase” AND “Registration” process to validate the purchase and make this agreement effective.


Xtensions reserves a right to change any or all of the above terms of the license agreement without any notification, apart from being allowed to withdraw support, purchase registration, updates and any or all terms of the license agreement in cases where a deviation has been noticed in adherence to the above usage guidelines and restrictions. The customer should withdraw using the product in case of a revoke of the license agreement, and failure to do so would result in the customer’s account being blocked to prevent any further access of services and support. Xtensions reserves its right to take a consequential legal action that would not be limited to claiming damages, ensuring recovery of implied legal and attorney fee. The customer would also be privy to any damage claims due to unauthorized usage of the product and acceptance of this agreement would also imply an acceptance of the legal recourse that would be taken in case of deviations from the terms and guidelines of this agreement.
